Midlands Quartz – Terms & Conditions
1. About Us
These Terms & Conditions apply to all products and services supplied by Midlands Quartz (“we”, “us”, “our”). By placing an order with Midlands Quartz, the customer (“you”, “your”) agrees to the following terms.
2. Quotations
- All quotations are valid for 14 days unless otherwise stated.
- Prices are subject to change due to supplier price increases, material availability, or specification changes.
- Quotes are based on the information provided at the time of enquiry and may change if measurements, layouts, or requirements differ.
- Any additional work requested after acceptance of the quotation may incur extra charges.
3. Deposits & Payments
- A deposit is required before any order is processed or materials are reserved.
- Final balances must be cleared prior to delivery, installation, or templating unless otherwise agreed in writing.
- Failure to make payment on time may result in delays to production, delivery, or installation.
- Deposits are non-refundable once materials have been ordered, fabricated, or allocated.
4. Templating & Measurements
- Customers are responsible for ensuring cabinets and supporting structures are fully fitted, level, and secure before templating takes place.
- Any changes made after templating may result in additional costs and delays.
- Midlands Quartz is not responsible for inaccuracies caused by third-party measurements, cabinet movement, uneven walls, or structural issues.
5. Product Information
- Quartz, stone, and porcelain surfaces may contain natural variations in shade, pattern, veining, and texture.
- Samples, brochures, and online images are for guidance only and may not represent the exact final product.
- Vein matching and pattern direction cannot be guaranteed unless specifically agreed in writing.
- Materials supplied may differ slightly from showroom displays due to batch variations.
6. Delivery
- Delivery dates provided are estimated and are not guaranteed.
- We will not be liable for delays caused by suppliers, transport companies, weather conditions, manufacturing issues, or circumstances outside our control.
- Customers must ensure clear and safe access for delivery.
- Additional charges may apply for failed deliveries, restricted access, waiting times, or re-delivery.
7. Installation
- Installation dates are provisional until confirmed.
- Customers must ensure all areas are clear and ready before installation begins.
- Plumbing, electrical, gas, decorating, tiling, and other finishing works are not included unless stated otherwise.
- Any issues caused by existing walls, floors, units, or structures may affect the final finish and are outside our responsibility.
8. Damage & Claims
- Customers must inspect all worktops and products upon completion.
- Any damage, defects, or concerns must be reported within 48 hours of delivery or installation.
- Claims made after installation, modification, misuse, or third-party works may not be accepted.
- Minor imperfections within normal manufacturing tolerances are not considered defects.
9. Care & Maintenance
- Customers are responsible for following all care and maintenance guidelines.
- Midlands Quartz is not liable for damage caused by misuse, excessive heat, impact, chemicals, standing water, or improper cleaning products.
- Although quartz is durable, it is not heatproof or indestructible.
10. Cancellations & Returns
- Orders for custom-made, cut-to-size, or fabricated products cannot be cancelled once production has begun.
- Bespoke and made-to-order products are non-refundable unless faulty.
- Returns are only accepted where agreed in writing and may be subject to restocking charges.
11. Warranty
- Manufacturer warranties apply where provided by the supplier.
- Warranties do not cover accidental damage, misuse, improper installation by third parties, or normal wear and tear.
- Customers may be required to register warranties directly with the manufacturer.
12. Limitation of Liability
- Our liability is limited to the value of the products and services supplied.
- Midlands Quartz will not be liable for indirect losses, loss of earnings, delays, accommodation costs, or consequential damages.
13. Force Majeure
We shall not be held responsible for delays or failure to perform obligations due to circumstances beyond our reasonable control, including supplier shortages, transport disruption, natural events, strikes, or other unforeseen events.
14. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
